2. About the Website
GotGold operates as a news and information website focused on precious metals and related markets. We publish, curate, and link to journalism, commentary, market data, research, and educational materials.
The Website and related content may not be complete or up to date. Your reliance upon any information provided by GotGold, GotGold’s contractors and employees, others appearing on the Website at GotGold’s invitation, or other visitors or users of this Website, is at your own risk. You understand that GotGold is not obligated to provide any maintenance, technical, or other support for the Website.
3. Ownership of Website and License
You acknowledge and agree that GotGold owns, or has rights in and to, the Website and its associated content, including all intellectual property rights. The Website is protected by applicable laws. GotGold grants you a limited, non-exclusive, non-sublicensable, royalty-free, non-assignable, and revocable license to use the Website for its customary and intended purposes. Using the Website in violation of this Agreement or for any purpose outside its intended use will result in the termination of this license. Any rights not expressly granted herein are reserved to GotGold.
4. Trademarks
All trademarks (registered and unregistered) displayed on the Website are the property of their respective owners. All GotGold marks, including GotGold® and associated logos, are the property of GotGold. The Website’s “look and feel,” including color selections, layout, and arrangement, is the trade dress of GotGold. You are prohibited from using GotGold’s trademarks, service marks, trade dress, or any colorable imitation thereof without GotGold’s prior written consent.
5. Account Registration
Account registration and use of the Website are free. You may browse content and use available Website features as a guest without registering for an account. If you choose to register, you agree to receive email and/or text notifications (you may opt out at any time).
We may request personally identifiable information (e.g., name, company, email, phone, mailing/billing/shipping addresses, country of residence, payment details) and may gather non-personal information to protect our customers and the Website and to improve our products and services. All information is governed by our Privacy Policy, incorporated herein by reference. In the event of a conflict between this Agreement and the Privacy Policy, the Privacy Policy controls.
You must ensure all information provided through your account is truthful, current, complete, and accurate, and you must update it as needed. You are prohibited from creating an account that impersonates another person, contains offensive or obscene language, or violates third-party rights. You will not use your account to interfere with others’ use of the Website. GotGold may restrict access to, monitor, suspend, disable, or delete your account at any time in its sole discretion.
You are responsible for maintaining the security of your account and password. You accept full responsibility for all use of your account. In the event of unauthorized access, you must contact GotGold immediately. You agree to hold harmless and indemnify GotGold for damages arising out of the use of your account.
6. Misuse and Fraud
We reserve the right, but undertake no obligation, to report and prosecute actual and suspected fraud or abuse related to the Website (including account creation, access, scraping, or manipulation of features). We may require further identity or ownership confirmation, and we may cancel or restrict accounts or access if fraud or abuse is suspected. We may submit relevant records to law enforcement and will cooperate with authorities.
7. User Generated Content
GotGold may allow submission of user-generated content (e.g., product reviews). Except as licensed herein, you own your content. Content posted publicly will be visible to all visitors and may not be confidential.
By submitting content, you grant GotGold a non-exclusive, irrevocable, royalty-free, worldwide, perpetual license to use it for Website-related purposes, including reproducing, creating derivative works, distributing, performing, displaying, selling, researching, archiving, and backing up. You waive all moral rights and any rights of publicity or privacy in the submitted content to the extent permitted by law.
You warrant your content does not violate third-party rights or any law. You are solely responsible for your content. GotGold may remove content and/or terminate access for violations, in its sole discretion.
8. Termination
Either GotGold or you may terminate this Agreement at any time for any reason by written notice. Termination does not affect rights or obligations accruing prior to termination.
9. Section 230 of the Communications Decency Act
You acknowledge that GotGold is an interactive computer service provider under 47 U.S.C. §230. Though GotGold may moderate content, it is not an information content provider for third-party content and is not liable for republication of third-party content. The Website may contain links to third-party sites or services; GotGold is not responsible for their content. Views expressed by users do not necessarily reflect GotGold’s views.
10. ThirdParty Content, Links, Feeds, and Terms (News Focus)
No endorsement or control. The Website aggregates and links to content, data, and services operated by third parties (including news publishers, research providers, marketdata vendors, video platforms, social networks, advertisers, and affiliates). GOTGOLD IS NOT RESPONSIBLE FOR CONTENT POSTED ON THE WEBSITE (INCLUDING THIRD-PARTY ADVICE OR LINKS) OR FOR TECHNICAL MALFUNCTIONS OR FAILURES. FORWARD-LOOKING STATEMENTS, IF ANY, INVOLVE RISKS AND UNCERTAINTIES.

14. Indemnity and Release

You release GotGold and its affiliates from all claims and damages arising out of or related to disputes connected to the Website.
15. Relationship
Your relationship with GotGold is that of a website user/visitor and content subscriber. No other relationship (e.g., agency, employment, franchise, joint venture, or partnership) is created.
16. No Waiver
GotGold reserves all rights and remedies at law or in equity. No delay or failure to exercise any right operates as a waiver.
17. No Assignment
You may not assign this Agreement or related rights/obligations without GotGold’s prior written consent. This Agreement binds and benefits permitted assignees and successors.
18. Force Majeure
If GotGold or the Website cannot provide services due to a force majeure event (an event beyond our reasonable control), we will not be in breach of this Agreement and will have no liability for failing to perform to the extent caused by such event.
19. Warranties, Representations, and Restrictions of Website Use
You represent that you have legal capacity to enter into this Agreement and are 18 years of age or older. Minors under 18 are prohibited from using the Website.
You warrant that information you provide is accurate and valid and that you will comply in good faith with this Agreement. You will not use the Website to violate third-party rights or any laws. You may not use any third-party intellectual property without permission. You may not reverse engineer any technology used to provide the Website or services.
Prohibited conduct includes, without limitation: (i) infringement; (ii) harassment or disruption; (iii) introducing malicious code or attacks; (iv) impersonation or misrepresentation; (v) unauthorized access attempts; (vi) spam or unsolicited solicitations; (vii) scraping or data collection without consent; (viii) using meta tags or hidden text utilizing GotGold marks; (ix) advertising goods/services except as expressly permitted; (x) interfering with others’ use; or (xi) assisting others to engage in prohibited activity.
20. Governing Law; Arbitration Agreement; Class Action Waiver; Waiver of Jury Trial
These Terms and Conditions, and any dispute arising hereunder, shall be governed by and construed pursuant to the laws of the Province of Alberta and the federal laws of Canada applicable therein.
To the extent permitted by applicable law, you hereby expressly waive your right to a trial by jury in any proceeding or litigation brought against GotGold with respect to these Terms and Conditions. Notwithstanding the foregoing, Silver Gold Bull will have the right to seek injunctive or other equitable relief in any provincial, state or federal court as may be necessary in order to enforce these Terms and Conditions or prevent an infringement of a third party’s rights. In the event equitable relief is sought, you hereby irrevocably submit to the personal jurisdiction of such court and waive all objections to the jurisdiction.
BY ENTERING INTO THESE TERMS AND CONDITIONS, YOU HEREBY IRREVOCABLY WAIVE ANY RIGHT YOU MAY HAVE TO JOIN CLAIMS WITH THOSE OF OTHERS IN THE FORM OF A CLASS ACTION OR SIMILAR PROCEDURAL DEVICE. ANY CLAIMS ARISING OUT OF, RELATING TO, OR CONNECTED WITH THESE TERMS AND CONDITIONS MUST BE ASSERTED INDIVIDUALLY.
You further acknowledge and agree that, regardless of any statute or law to the contrary, any claim or cause of action you may have arising out of, relating to, or connected with any transaction contemplated hereunder must be filed within one calendar year after such claim or cause of action arises, or forever be barred.
21. Severability
If any provision of this Agreement is held invalid, the parties intend that the court give effect to the parties’ intentions as reflected in the provision, and the remaining provisions remain in full force and effect.
22. Entire Agreement; Integration
This Agreement constitutes the entire agreement between you and GotGold and governs your use of the Website, superseding prior agreements. GotGold hereby incorporates its Privacy Policy into this Agreement.
23. Statute of Limitations
REGARDLESS OF ANY STATUTE OR LAW TO THE CONTRARY, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO THIS AGREEMENT MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE OR BE FOREVER BARRED.
24. Child Online Privacy Protection Act
The Website is not directed to persons under the age of eighteen (18), and GotGold will not knowingly collect personally identifiable information from children under the age of eighteen (18). If GotGold inadvertently collects such information, GotGold will delete it in accordance with its security protocols.
25. Reservation of Rights
All rights not expressly granted herein are reserved to GotGold. No provision of this Agreement shall be construed as conferring any rights or benefits to third parties unless expressly stated.
26. Privacy
Use of this Website is subject to the terms of our Privacy Policy, which is incorporated into and made part of this Agreement. By using this Website, you agree to be bound by the terms of our Privacy Policy. We reserve the right, and you authorize us, to use information regarding your use of this Website, account registration, and any other personal information provided by you in accordance with the Privacy Policy.
